Landlords: Are you aware of what is changing on the 1st October 2022?

Claire Pile MARLA of Stags Residential Lettings confirms that, from 1st October 2022, smoke and carbon monoxide alarms will be compulsory.

The regulation states that all rented properties in England must provide a carbon monoxide alarm in rooms where there is any type of fixed combustion application, including gas boilers, from 1st October 2022. Previously, the requirements have only applied to solid fuel burning appliances including wood burners and open fires.

Under the Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022, all landlords of private and social housing must ensure a smoke alarm is fitted on every floor of their property where there is a room being used, wholly or partly, as living accommodation.

Claire Pile advises that “It is likely that most landlords already meet the requirements of the amended regulations, however, we would urge any landlord who is unsure to check as soon as possible in order to avoid risks to health and safety, breaching the rules and the potential of costly fines. Many landlords are also not aware of their obligation to test and record that an alarm is in working order at the commencement of any tenancy.”

From 1st October 2022, when a tenant reports that an alarm is not in properly working order, the landlord must repair or replace the alarm as soon as reasonably practical.
