How can a Stags Expert Witness help settle your property dispute?

What kind of advice and assistance can Stags provide to help settle your property dispute?

Stags Professional Services team provides valuation advice to solicitors and other clients in the context of property disputes. Sometimes we are instructed directly by clients who can foresee problems arising and require an independent professional to assist the parties in reaching a settlement without it escalating into a potentially costly formal dispute.

The types of property dispute that Stags has experience in assisting with include the following:

•Partnership dissolution
•Professional negligence
•Matrimonial proceedings
•Covenants and rights of way
•Dilapidations
•Valuation of tenants' improvements

A number of core professionals within Stags are regularly instructed as valuation experts in professional negligence cases. These include valuers, solicitors and sometimes architects. Stags is also regularly instructed to assist with matrimonial matters, disputes involving covenants, rights of way, failures by landlords to repair and other contractual issues. We act for both claimants and defendants and are also frequently instructed as Single Joint Experts.

Those undertaking the work are Fellows (FRICS) or Members (MRICS) of the Royal Institution of Chartered Surveyors (RICS). For agricultural matters they are also often Fellows of the Agricultural Valuers Association (FAAV), and for valuation we use RICS-registered valuers. All of our Expert Witnesses are experienced and used to acting in difficult circumstances.

The qualifications mean that extensive training has taken place and that the reports produced will be considered, backed up and will stand up under scrutiny, either by the parties or by the court where applicable.

Our advice draws on appropriate agency expertise from across the West Country. Stags has 21 offices and sells a large number of properties each year. This first-hand evidence, together with the ability to discuss properties with colleagues in our residential estate agency or other specialist departments including Farm Agency, Equestrian and Holiday Complexes, gives us unrivalled access to the market helping us reach a justifiable conclusion. This evidence can be a critical element in the context of retrospective valuations and opinions.
