The property is to be offered for sale by Traditional Public & Online Auction at 6.00pm on Wednesday 31st May 2023 at The Lanhydrock Hotel and Golf Club, Lostwithiel Road, Bodmin, PL30 5AQ.

The property will be sold subject to an undisclosed reserve and the vendor/s reserve the right for the auctioneer to bid in the usual way on their behalf up to the reserve

SITUATION
The village of Foxhole offers a range of local amenities including village stores and post office, health centre, fish and chips, primary school and recreational ground. These are supplemented further by the town of St Austell, about 5 miles to the east, where there is a station on the London Paddington line. Surrounding the town and other neighbouring villages is a landscape well known for its clay tips and pits, created by the 250 year old clay mining industry. OVERAGE PROVISION
An Overage provision will be included within the contract, requiring the Purchaser and their successors in title to pay the Vendor 30% of any uplift in value, triggered on the granting of planning permission (or equivalent) for any residential accommodation, within 30 years from completion of this purchase. For the avoidance of doubt, planning consent for agricultural or equestrian buildings will not trigger the overage.

WAYLEAVES AND RIGHTS OF WAY
The land is sold subject to and with the benefit of any wayleave agreements in respect of electricity or telephone equipment and the property is sold subject to and with the benefit of any public or private rights of way. A public footpath runs through part of the shared access area for lots 1, 2 and 3 and along the dividing boundary of lots 2 and 3, from the NW to the SE. FENCING
Within 6 months of completion:

The purchaser of lot 1 will be responsible for the erection and maintenance of a stockproof dividing fence on its southern boundary (between lots 1 and 2). The purchaser of lot 3 will be responsible for the erection and maintenance of a stockproof fence on the dividing (eastern) boundary with lot 2, as well as supplying two gates and four gateposts to enable access to both lots from the shared access box. TENURE & COMPLETION
The property is sold freehold with vacant possession on completion 6 weeks after the auction, or earlier by agreement.

PROOF OF IDENTITY
Under Money Laundering Regulations 2017 it is a requirement for Estate Agents to perform due diligence checks on any person that intends to bid at auction.

There will be a requirement for ALL bidders to register via Bamboo Fusion and complete the ID checks in advance of the auction date. There is no charge for registration.

BUYERS & ADMINISTRATION FEE
The successful purchaser(s) of each lot will be liable to pay the sum of £5,000. From this a "buyer's fee" of £2,400 (Inc. VAT) is retained by Stags/Bamboo Auctions as a contribution towards the online platform costs, and £2,600 is payable towards the purchase price/deposit.

An additional "administration" fee of £600 including VAT will be payable by the successful purchaser of each lot immediately after the auction. This will be separately invoiced by Stags. The purchasers shall also reimburse the vendor the cost of the searches carried out, on Completion. (This would usually be paid by a buyer in a private treaty sale).

From St Austell, follow the A3058 west, passing through the villages of Trewoon and Lanjeth. Upon reaching High Street and after approximately 4 miles, turn right onto the B3279 signposted Foxhole. Proceed along this road for just over a mile into the village of Foxhole, passing the post office and primary school, before turning right into Fortescue Close. To access lots 1, 2 and 3 continue, proceeding into Braddock Close, where the access to the land can be found in the north-eastern corner between number 17 & 18. To access lot 4, instead of proceeding into Braddock Close, take the next available right hand turning and continue through Fortescue Close where the access can be found adjacent to number 59.
