Tenancy Deposit Scheme Comes Into Force on 6th April 2007.

The Government has recently announced that the long awaited Tenancy Deposit Scheme will come into force from the 6th April 2007.

It will be a legal requirement for every Landlord in the private rented sector to hold deposits in either a scheme operating an Insured Option or to use the Custodial Scheme. The Tenancy Deposit Scheme for Regulated Agents (TDSRA) has been running a scheme for Regulated Agents who are members of ARLA, the NAEA and RICS.

Housing Minister, Baroness Andrews said, ?Tenancy Deposit Schemes would help put an end to unfairly withheld deposits. Tenancy Deposit protection is a key consumer protection measure which would also introduce a simpler way of resolving deposit disputes and help raise standards in the private rented sector. But importantly under the new schemes alternative dispute resolutions services will be free to use for both Landlord and Tenant for the first time?.

From April 6th 2007 statutory deposit schemes will apply to all Assured Shorthold Tenancies where a deposit is taken in England and Wales. They do not apply in Scotland or Northern Ireland. Stags are full members of the Tenancy Deposit Scheme for Regulated Agents and therefore will be able to hold deposits on behalf of all Landlords through the insurance-based scheme for all lettings, through their Let Only, Rent Collection or Full Management Services. The Dispute Service Limited was established in 2003 to provide dispute resolution and complaints handling services to the Lettings industry.
